The waitlist and demos

Joining the waitlist is a request, not a commitment by either of us. We choose which stores to bring on and when, at our discretion. A booked demo is a conversation. There are no fees during the beta.

Using fina in the beta

If we bring your store on, you get a limited, non-exclusive, non-transferable, revocable license to use fina for your own stores while the beta runs. fina is pre-release: we may change it, pause it, or withdraw it, and we do not promise any particular feature, support level, or continued availability.

• Do not reverse engineer fina or try to derive its source.
• Do not use it to build or benchmark a competing product, or for a competitor's benefit.
• Do not resell it, sublicense it, or share your access with anyone outside your store.
• Keep your sign-in details private, and tell us if you think they have been exposed.

The accounts you connect, such as your point of sale, stay yours. You are responsible for them and for their providers' terms, and you confirm you have the rights needed to share that data with us.

Your data

Your store's data is yours. You give us a license to use it to provide fina to you while we work together. Our privacy policy explains what we collect, how we use it, and how we delete it.

Feedback

Anything you tell us about fina, from bug reports to ideas, we may use freely and without obligation or payment. We will not treat feedback as confidential, so keep your store's confidential information out of it, or tell us when something is.

The decisions are yours

fina drafts buying decisions. You review and approve them. It is pre-release software, it can be wrong, and it can be interrupted. Check its output before you rely on it, and keep your own records and systems. Orders you approve are your orders with your suppliers; we are not a party to those transactions.

What is ours

fina, this website, and the fina name and marks belong to us, including improvements we make, whether or not they came from feedback. Nothing here gives you rights in them beyond the license above.

Confidentiality

What we show you of fina before it is released is confidential: keep it to the people in your store who need it. We hold your store's information to the same standard, as our privacy policy describes. Neither of us will use the other's name publicly without written consent.

No warranty

FINA AND THIS WEBSITE ARE PROVIDED AS IS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Limits on liability

NEITHER OF US IS LIABLE TO THE OTHER FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. EACH SIDE'S TOTAL LIABILITY UNDER THESE TERMS IS LIMITED TO US $1,000, EXCEPT FOR BREACH OF CONFIDENTIALITY, A DATA SECURITY INCIDENT, INFRINGEMENT OF THE OTHER'S INTELLECTUAL PROPERTY, FRAUD, OR WILLFUL MISCONDUCT, AND EXCEPT WHERE THE LAW DOES NOT ALLOW A LIMIT.

Ending it

Either of us can end your access at any time. When it ends, stop using fina, and we delete your store's identifiable data within thirty days as our privacy policy describes. The sections on feedback, what is ours, confidentiality, no warranty, and limits on liability continue to apply.

The legal details

These terms are governed by Delaware law, and disputes go to the state and federal courts in Delaware. If part of these terms cannot be enforced, the rest still applies. We may update these terms; the current version with its date is always here, and design partners hear from us first about changes that affect them.
